Liability Waiver

In consideration of being permitted to participate in activities, including but not limited to pony rides, petting zoo interactions, birthday parties, and any other events (collectively referred to as "Activities") hosted by Hidden Haven Events, LLC ("the Company") at its property in Point Pleasant, West Virginia, I, the undersigned participant (or parent/legal guardian if the participant is a minor), acknowledge, agree, and represent the following:

1. Acknowledgment of Risks      

I understand that participation in the Activities involves inherent risks, including but not limited to falls, animal bites, scratches, kicks, allergic reactions, property damage, personal injury, or death. I acknowledge that animals can be unpredictable, and the outdoor environment may present additional hazards such as uneven terrain, weather conditions, or equipment failure. I assume full responsibility for any risks associated with my  (or my child’s) participation.

2. Voluntary Participation          

I am participating (or allowing my child to participate) in the Activities voluntarily, with full knowledge of the risks involved, and I agree to accept all such risks.

3. Release and Waiver of Liability       

I, for myself (and/or my child), my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree not to sue Hidden Haven Events, LLC, its owners, employees, agents, volunteers, landlord, associates, and/or affiliates (collectively, "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of my (or my child’s) participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.

4. Indemnification      

I agree to indemnify and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorney fees) brought by me, my child, or any third party arising from my (or my child’s) participation in the Activities.

5. Medical Authorization     

I certify that I (or my child) am/is physically capable of participating in the Activities. In the event of an emergency, I authorize the Company to secure medical treatment for me (or my child) and agree to assume all costs associated with such treatment.

6. Photography/Video Release    
I grant Hidden Haven Events, LLC permission to use photographs or videos taken of me (or my child) during the Activities for promotional or other purposes without compensation.

7. Governing Law     

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the State of West Virginia. Any disputes arising hereunder shall be resolved in a court of competent jurisdiction in Mason County, West Virginia.

8. Severability     

If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment of Understanding

I have read this Waiver and Release of Liability, fully understood its terms, and sign it freely and voluntarily without any inducement. I am at least 18 years of age and legally competent to sign this agreement (or, if signing for a minor, I am the parent or legal guardian with authority to do so).

​WV CODE §19-36-4 NOTICE: Under West Virginia law, there may be limited liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism business if the injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to landscape, terrain, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.
